All copyrights for digital products (including graphics, artwork, patterns, templates and color palettes), website design and copy, and all other written and visual materials presented on nanscottdesignstudio.com are retained by Nan Scott Design Studio, LLC, and are protected by United States Copyright Law.

The exception is the free product "Quick Classic Quotes Page Accessories," for which there is no claim to copyright. Customers wishing to use these quotes for other than personal projects will be responsible for researching appropriate copyrights.

The terms "Files" and "Purchased Products" include files downloaded at no charge, due to a Pro Membership or because they are offered as free downloads on the website. "Flattened files" means the project has been saved as a JPEG, with only a single Background layer and all Page Template components have been replaced with personal materials.

By downloading these files from the website, and checking "I agree with the Terms of Use, Personal Use License" you have legally committed to the following:

YOU MAY:
Use or transfer downloaded files on no more than two personal computers within your physical address, including laptop computers.

Use the digital files from this site in your personal projects. You may not resell these completed personal projects in either printed or digital format. Files must be flattened JPEGs in all projects posted online.

Use the flattened JPEG files to produce commercially-printed photobooks with no more than 50 copies printed. You may not resell these photobooks in either digital or printed format.

Email your finished projects, and share completed pages on Facebook and other social networking sites, as flattened, finished JPEGs ONLY. All template elements (such as photo placeholders and text blocks) must be replaced with personal materials.

Submit flattened projects for publication in scrapbooking or other magazines, or to digital galleries, but agree to acknowledge proper credit to nanscottdesignstudio.com for products used.

All products are for use in your personal projects only.

Personal use is limited to: personal scrapbooks, scrapbook pages for online sharing or printing, scrapbooks created as gifts (no compensation), greeting cards and invitations (print and digital) for personal use, personal blog or website backgrounds (providing no downloads are offered), photo mats.

YOU MAY NOT:
Use any of these products to create templates or digital products and claim that they are your own design, even if they are altered from the originals, and even if you intend to share them free of charge.

Resell projects (either digital or printed) created with these files without specific written permission from Nan Scott Design Studio, LLC.

Post, share, mail or email any files downloaded from nanscottdesignstudio.com, in either printed or digital formats, in flattened or layered formats, even if the files had been offered free on the website.

Use the products to produce materials, either for private or public use, that are harmful, pornographic, racially motivated, or harmful to another person.

Share, loan, rent, resell, distribute, transfer, or post on a bulletin board, network, modem, Internet or web page any files downloaded from nanscottdesignstudio.com.

Make copies on any media, for reasons other than personal back-up.

Prohibited uses:  Scrapbooking for another person for a reason other than a gift (whether paid for your services or not), sharing files with someone outside of your household or on more than two computers in your household, altering files and reselling them as your own creations.

PENALTIES
Violators of these terms hereby agree to pay liquidated damages to Nan Scott Design Studio, LLC in the amount of $5,000.00  per incident for any non-personal and/or commercial use. In addition, should Nan Scott Design Studio, LLC incur any attorney fees or other costs in collecting and/or enforcing this liquidated damages provision, violator agrees to reimburse all such fees and/or costs. If you use this product in an unauthorized personal manner (such as unauthorized sharing with individuals or groups) you will be liable for liquidated damages of $1,000 per incident and all attorney's costs and fees as described above.  In the event there is a violation and the fraudulent recipient also violates the terms, the original purchaser will be liable for subsequent violations by the fraudulent recipient.

LIMITATION OF LIABILITY
Under no circumstances shall Nan Scott Design Studio LLC be responsible for any damages or loss that result from the use of, or inability to use any of the products sold or distributed by Nan Scott Design Studio, LLC.  The information contained on this site is provided "as is" without warranty of any kind.

END USER DOWNLOAD AGREEMENT
This Nan Scott Design Studio Agreement (the "Agreement") becomes a binding contract between you and Nan Scott Design Studio, LLC when you download a Nan Scott Design Studio, LLC product.

Nan Scott Design Studio, LLC's total liability, whether for breach of contract, warranty, negligence, strict liability in tort or otherwise, is limited to the price of the particular product sold under these terms with respect to which losses or damages are claimed. In no event will Nan Scott Design Studio, LLC be liable for any loss of use, loss of time, inconvenience, commercial loss, lost profits or savings or other incidental or consequential damages to the full extent such may be disclaimed by law. No action will be brought for any breach of these Terms more than one year after the accrual of such cause of action. You agree that this limitation of liability is comprehensive and applies to all damages of any kind, including without limitation direct, indirect, compensatory, special, incidental, punitive and consequential damages. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to Buyer.

Because Nan Scott Design Studio products are downloadable, they cannot be returned.
