Consultants can pursue one or both of two business plans: Digital Design Consultant/Album Designer, and Digital Design Consultant/Modern Digital Scrapooking Educator. The Album Designer business plan allows you to operate under the Digital Design Consultant Terms of Use and design pages and albums for compensation by clients. The Modern Digital Scrapbooking Educator teaches clients one-on-one or in Digital Design Nights Out.

The following Terms of Use apply to only individuals who have the designation of Active Digital Design Consultant ("ADDC"). An Active Digital Design Consultant is defined as an individual whose Digital Design Consultant membership is in effect, as determined by Nan Scott Design Studio, LLC ("the Studio"). This designation becomes effective upon confirmation of payment and is good for one year from the date of the full payment, unless cancelled for non-payment. The Studio retains the right to determine whether an individual is an ADDC at any given point in time. If an individual is in doubt whether they are an Active Digital Design Consultant, they should contact careers@nanscottdesignstudio.com. In the event an individual is no longer an Active Digital Design Consultant, whether for subscription non-payment, subscription expiration, or any other reason, they become a Former Digital Design Consultant ("FDDC"). In the event an individual becomes an FDDC, use for all previously-downloaded products, and all future legitimately downloaded products from Nan Scott Design Studio, LLC revert to personal use only (see Personal Terms of Use), regardless of when the product was downloaded. All copyrights for digital products (including graphics, artwork, patterns, templates and color palettes), website design and copy, and all other written and visual materials presented on nanscottdesignstudio.com are retained by Nan Scott Design Studio, LLC, and are protected by United States Copyright Law. The exception is the free product "Quick Classic Quotes Page Accessories," for which there is no claim to copyright. ADDCs wishing to use these quotes for other than personal projects will be responsible for researching appropriate copyrights. The terms "Files" and "Purchased Products" include files downloaded at no char ge, due to a Pro Membership, a Digital Design Consultant Membership, or because they are offered as free downloads on the website. "Flattened files" means the project has been saved as a JPEG, with only a single Background layer, and all original Page Template layer contents have been replaced with personal materials. By downloading these files from the website, and checking "I agree with the Terms of Use, Digital Design Consultant Use License" you have legally committed to the following: You agree to use the "Digital Design Consultant Agreement for Professional Digital Scrapbooking Services" ("Agreement"), which will be emailed directly to you with all other membership information, with all clients for whom they do professional services. As an ADDC, you may: 1) Copy or transfer downloaded files on no more than two personal computers within your physical address, including laptop computers. 2) Use the products in all allowed personal uses as defined in Terms of Use, Personal, as well as in the manner defined in this Terms of Use. 3) Use all products you downloaded from the Studio (whether the downloads were made during the time you are an ADDC or were legitimately downloaded prior to becoming an ADDC) in projects for which you are paid by a client, during the time you are an ADDC. 4) Use downloaded products to create the following projects: scrapbooks, scrapbook pages, greeting cards, invitations, announcements, event programs, calendars, blog backgrounds, photo mats, or photo albums, for private individuals. Use of flattened files as JPEGs submitted to commercial photobook producers is permitted, but printing is limited to 100 copies total. ADDCs are permitted to release flattened files to their clients in digital format on CDs or via email or ftp transfer. The Agreement binds the client to using these images for personal use only, whether as a digital image or in a printed format. As an ADDC, you may not: Use any of these products to create templates or digital products and claim that they are your own design, even if they are altered from the originals, and even if you intend to share them free of charge. Post, share, mail or email any files downloaded from nanscottdesignstudio.com, in either printed or digital formats, in flattened or layered files. Share, loan, rent, resell, distribute, transfer, or post on a bulletin board, network, modem, Internet or web page any files downloaded from nanscottdesignstudio.com. Use the products to produce materials, either for private or public use, that are harmful, pornographic, racially motivated, or harmful to another person. Make copies of downloaded files on any media, for reasons other than personal back-up. PENALTIES If you have any questions about permitted uses, you may contact: Nan Scott Design Studio, LLC info@nanscottdesignstudio.com LIMITATION OF LIABILITY Under no circumstances shall Nan Scott Design Studio LLC be responsible for any damages or loss that result from the use of, or inability to use any of the products sold or distributed by Nan Scott Design Studio, LLC. The information contained on this site is provided "as is" without warranty of any kind. END USER DOWNLOAD AGREEMENT Nan Scott Design Studio, LLC's total liability, whether for breach of contract, warranty, negligence, strict liability in tort or otherwise, is limited to the price of the particular product sold under these terms with respect to which losses or damages are claimed. In no event will Nan Scott Design Studio, LLC be liable for any loss of use, loss of time, inconvenience, commercial loss, lost profits or savings or other incidental or consequential damages to the full extent such may be disclaimed by law. No action will be brought for any breach of these Terms more than one year after the accrual of such cause of action. You agree that this limitation of liability is comprehensive and applies to all damages of any kind, including without limitation direct, indirect, compensatory, special, incidental, punitive and consequential damages. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to Buyer. Because Nan Scott Design Studio products are downloadable, they cannot be returned. |
